Event Waiver & Rider Release

This Event Waiver & Rider Release (“Waiver”) applies to Vuelta Chapala (the “Event”).

Vuelta Chapala is a branded event operated by HIRAM SERVICES & SOLUTIONS, S. de R.L. de C.V., with legal address at Greco 517, Prados Providencia, Guadalajara, Jalisco, México, C.P. 44670, telephone +52 33 2037 6027, and email [email protected] (“Organizer,” “we,” “us,” or “our”). Certain local ground operations in Mexico may be carried out by affiliates, contractors, suppliers, staff, or authorized local service providers engaged by the Organizer.

By accepting this Waiver, submitting an application, registering, checking in, or participating in the Event, you (“Participant,” “Rider,” or “you”) acknowledge and agree as follows:

Please read this document carefully before proceeding. It contains important legal terms and affects your legal rights, including assumption of risk, release of liability, medical authorization, and electronic acceptance.

Vuelta Chapala is intended exclusively for riders who are 18 years of age or older. By proceeding you represent that you are legally an adult and capable of accepting this agreement in your own name.

Once you have read and understood this Waiver, continue to the registration form to complete your details and record your electronic acceptance.

1. Purpose of This Waiver

This Waiver is a material condition of participation in the Event. Its purpose is to:

  • confirm your understanding of the inherent risks associated with participation in a demanding road cycling event;
  • confirm your assumption of those risks to the fullest extent permitted by applicable law;
  • establish your obligations regarding safety, conduct, and compliance;
  • authorize reasonable emergency response actions if necessary;
  • regulate use of image, likeness, and related event content; and
  • limit and release liability to the fullest extent permitted by applicable law.

If you do not agree to this Waiver, you must not participate in the Event.

2. Condition of Participation

Participation in the Event is voluntary.

You understand and agree that acceptance of this Waiver is mandatory and that no person may participate in the Event without first completing all required documentation, including this Waiver and any related registration, safety, or rider information forms required by the Organizer.

3. Acknowledgment of Inherent Risks

You understand and acknowledge that road cycling and participation in the Event involve inherent, obvious, and significant risks, whether known or unknown, foreseeable or unforeseeable, including the risk of:

  • serious bodily injury;
  • illness;
  • dehydration;
  • heat-related conditions;
  • exhaustion;
  • falls and crashes;
  • collisions with vehicles, cyclists, pedestrians, animals, road hazards, or fixed objects;
  • equipment or mechanical failure;
  • poor road surfaces, gravel, potholes, debris, or changing terrain;
  • weather-related hazards, including heat, rain, wind, lightning, fog, or reduced visibility;
  • delayed, limited, or unavailable medical response;
  • permanent disability; and
  • death.

You further acknowledge that these risks may arise from your own actions or omissions, the actions or omissions of other participants or third parties, road or environmental conditions, force majeure events, equipment failure, or the acts or omissions of the Organizer or others, except where liability cannot lawfully be excluded.

4. Physical Fitness and Personal Responsibility

You represent and warrant that:

  • you are physically and mentally fit to participate in the Event;
  • you possess the cycling ability, judgment, training, and experience reasonably necessary to participate safely;
  • you are responsible for evaluating your own condition, readiness, hydration, nutrition, equipment, and pacing;
  • you have not been advised by a qualified medical professional to avoid this type of activity, or, if you have, you have independently chosen to participate notwithstanding such advice and assume the associated risks;
  • you will immediately withdraw and notify Event staff if you become unable to continue safely.

You understand that the Organizer does not provide individualized medical evaluation, fitness assessment, coaching, or suitability advice.

5. Equipment and Bicycle Condition

You acknowledge that it is your sole responsibility to ensure that your bicycle, helmet, shoes, lights, hydration setup, clothing, and all other personal equipment used in connection with the Event are safe, appropriate, properly maintained, and in good working condition.

You understand and agree that:

  • helmet use may be mandatory at all times while riding in connection with the Event;
  • the Organizer may inspect or decline unsafe equipment at its reasonable discretion;
  • any mechanical support that may be offered during the Event is a courtesy service only and does not shift responsibility for the condition or operation of your bicycle or equipment to the Organizer.

6. Compliance with Rules and Instructions

You agree to comply fully with:

  • all Event rules;
  • all rider briefings;
  • all route controls and timing requirements;
  • all traffic rules and lawful authority instructions;
  • all directions given by the Organizer, staff, marshals, medical teams, police, support drivers, contractors, and authorized representatives.

You understand that failure to follow instructions may increase risk to yourself and others and may result in neutralization, disqualification, removal from the Event, or denial of further participation, without refund.

7. Public Roads and Traffic Exposure

You understand that the Event may take place in whole or in part on public or partially controlled roads, and that traffic exposure, variable road conditions, intersections, vehicles, pedestrians, animals, debris, weather, and unforeseen hazards may be present even where support measures or traffic control exist.

You agree to ride prudently, remain attentive at all times, and exercise independent judgment consistent with the conditions encountered.

You understand that no route, escort, marshal, or support presence can eliminate all road or traffic-related risk.

8. Assumption of Risk

To the fullest extent permitted by applicable law, you voluntarily and knowingly assume all risks arising out of or related to your application for, registration for, travel to, attendance at, and participation in the Event, including risks occurring before, during, or after the official ride, and whether associated with riding, staging areas, start and finish zones, feed zones, transfers, rider briefings, packet collection, or other Event-related activities.

You acknowledge that participation is your own choice and that you are solely responsible for the consequences of that choice, except to the extent liability cannot lawfully be excluded or limited.

9. Release and Waiver of Liability

To the fullest extent permitted by applicable law, you hereby release, waive, and discharge the Organizer, its members, managers, officers, directors, employees, contractors, staff, affiliates, local operators, suppliers, sponsors, support personnel, photographers, volunteers, agents, representatives, and authorized service providers (collectively, the “Released Parties”) from any and all claims, demands, actions, causes of action, liabilities, losses, damages, costs, or expenses arising out of or related to your participation in the Event, including claims for personal injury, illness, property damage, economic loss, or death.

This release applies regardless of the legal theory asserted, including contract, tort, negligence, or otherwise, except to the extent that a claim arises from:

  • willful misconduct;
  • gross negligence; or
  • liability that cannot lawfully be excluded or limited under applicable law.

Nothing in this Waiver excludes or limits any non-waivable right or protection that applies to you under mandatory law.

10. Indemnity

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Released Parties from and against any claim, liability, damage, loss, cost, or expense, including reasonable legal fees, arising out of or related to:

  • your acts or omissions;
  • your breach of this Waiver, the Event Terms, or Event rules;
  • injury or damage caused by you to any person or property;
  • your unlawful, reckless, abusive, or unsafe conduct;
  • any false, incomplete, or misleading information provided by you in connection with the Event.

This indemnity shall not apply to the extent a claim arises directly from the gross negligence, willful misconduct, or non-excludable liability of a Released Party.

11. Medical Treatment and Emergency Authorization

You understand that the Organizer may, but is not obligated to, provide or coordinate access to first aid, emergency response, ambulance services, or other medical assistance during the Event.

If you are injured, ill, unconscious, incapacitated, or otherwise unable to make decisions, you authorize the Organizer and its authorized representatives to:

  • obtain or arrange emergency medical assessment, treatment, transportation, evacuation, or hospital care on your behalf as they reasonably deem necessary;
  • share relevant emergency information with medical personnel, emergency responders, hospitals, insurers, or authorities where reasonably necessary for your care or safety.

You acknowledge and agree that:

  • any such action may be taken without prior consultation with you if circumstances make that impracticable;
  • the Organizer does not guarantee the availability, timeliness, adequacy, or success of any emergency response or medical treatment;
  • all resulting costs, including ambulance, hospital, physician, medication, rescue, transport, evacuation, repatriation, or related charges, are your sole responsibility unless otherwise required by law.

12. Medical Information and Emergency Contact Data

You understand that the Organizer may request emergency contact details and, where relevant to Event safety, limited health-related information voluntarily provided by you.

You represent that any such information is true, current, and complete to the best of your knowledge.

You understand that such information may be processed for safety, emergency response, legal compliance, and Event administration purposes in accordance with the applicable Privacy Policy and data protection law.

13. No Insurance Provided

You understand that the Organizer does not provide personal health, accident, disability, cancellation, evacuation, travel, or property insurance for Participants unless expressly stated otherwise in writing.

You are solely responsible for obtaining insurance coverage appropriate to your needs and risk exposure.

14. Personal Property

You are solely responsible for your bicycle, helmet, equipment, bags, tools, electronics, clothing, documents, valuables, and all other personal property brought to or used in connection with the Event.

To the fullest extent permitted by law, the Released Parties shall not be liable for loss, theft, damage, delay, or misplacement of personal property, except to the extent caused by their gross negligence, willful misconduct, or non-excludable legal responsibility.

15. Organizer’s Right to Neutralize, Remove, or Disqualify

You acknowledge that the Organizer may, in its reasonable discretion, neutralize, stop, reroute, extract, remove, suspend, or disqualify you from the Event where necessary for safety, medical, operational, legal, or disciplinary reasons, including where you:

  • appear unable to continue safely;
  • miss a time cut-off;
  • refuse to follow instructions;
  • ride dangerously or recklessly;
  • are intoxicated or under the influence in a manner that affects safety;
  • use unsafe equipment;
  • engage in threatening, abusive, fraudulent, or disruptive conduct.

You agree that such decisions may be made rapidly and in the field and shall be binding at the Event level, subject to applicable law.

16. Photography, Video, and Likeness Release

You acknowledge that the Event may be photographed, filmed, recorded, or otherwise documented by the Organizer or its authorized partners.

By participating in the Event, you grant the Organizer and its affiliates, licensees, successors, sponsors, media partners, and authorized service providers a worldwide, royalty-free, non-exclusive right to capture, use, reproduce, edit, publish, display, distribute, communicate, archive, and otherwise exploit your image, likeness, name, voice, riding image, comments, and related event content in connection with:

  • Event promotion;
  • editorial or documentary coverage;
  • social media;
  • website content;
  • advertising and marketing communications;
  • historical archives;
  • internal and external brand communications.

You waive any claim for compensation arising solely from such use, except where prohibited by applicable law.

17. Conduct, Sportsmanship, and Respect

You agree to behave responsibly and respectfully toward other riders, staff, volunteers, service providers, authorities, local communities, road users, and any third party affected by the Event.

You understand that harassment, aggression, abuse, intimidation, discrimination, unsafe conduct, fraud, or deliberate rule violations are inconsistent with the Event and may result in removal without refund.

18. Third-Party Acts and Independent Services

You understand that parts of the Event environment may involve third parties, including police, emergency responders, venues, traffic authorities, contractors, suppliers, mechanics, photographers, or other service providers.

To the fullest extent permitted by law, the Released Parties shall not be liable for the independent acts, omissions, delays, or failures of such third parties beyond the Organizer’s reasonable control, except to the extent of their own gross negligence, willful misconduct, or non-excludable liability.

19. No Warranty or Guarantee of Safety

You understand and agree that the Organizer cannot guarantee your safety or eliminate the risks of participation.

Any support services, route planning, safety measures, communications, or emergency arrangements are intended to reduce risk, not eliminate it.

Participation remains inherently hazardous.

20. Relation to Other Event Documents

This Waiver must be read together with the applicable:

  • Event Terms & Conditions;
  • Shared Responsibility Letter (Carta de Responsabilidad Compartida);
  • Cancellation, Refund & Force Majeure Policy;
  • Privacy Policy; and
  • any rider guide, rider briefing, check-in instruction, or operational communication issued by the Organizer.

If there is any inconsistency between this Waiver and mandatory law, mandatory law shall prevail to that extent only.

21. Governing Law, Negotiation, and Dispute Resolution

This Waiver and any non-contractual obligations arising out of or in connection with it shall be governed by and construed in accordance with the applicable federal laws of Mexico and, where relevant, the laws of the State of Jalisco, without regard to conflict of laws principles.

Before commencing formal proceedings, the Participant and the Organizer shall first attempt in good faith to resolve any dispute through direct written negotiation for a period of at least thirty (30) calendar days after written notice of dispute is delivered by one party to the other.

If the dispute is not resolved through negotiation, it shall, to the fullest extent permitted by applicable law, be finally resolved by confidential binding arbitration seated in Guadalajara, Jalisco, Mexico, before a sole arbitrator.

The arbitration shall be administered by the Centro de Arbitraje de México (CAM) in accordance with its rules in force at the time the arbitration is commenced, except as otherwise expressly agreed in writing by the parties.

Notwithstanding the foregoing:

(a) either party may seek interim, conservatory, or injunctive relief from any court of competent jurisdiction in Mexico where necessary to protect rights pending final resolution of the dispute;

(b) nothing in this Waiver shall prevent a Participant from exercising any non-waivable right under applicable consumer protection law, including the right to file a complaint or seek conciliation before PROFECO or any other competent authority in Mexico where such right cannot lawfully be waived or restricted; and

(c) if any arbitration provision is held unenforceable as to a particular claim or participant under mandatory law, that claim shall be submitted exclusively to the competent courts of Guadalajara, Jalisco, Mexico, unless another forum is required by mandatory law.

22. Language

This Waiver may be made available in more than one language for convenience. In the event of any inconsistency between language versions, the Spanish version shall prevail for purposes of interpretation, enforcement, and any proceeding brought in Mexico, or whenever required by mandatory law. The English version may be used for convenience and for international communications only.

23. Electronic Acceptance

You agree that digital signatures, checkboxes, online confirmations, electronic acknowledgments, and other electronic means of acceptance may constitute valid and binding acceptance of this Waiver to the fullest extent permitted by law.

24. Severability

If any provision of this Waiver is held invalid, unlawful, or unenforceable, the remaining provisions shall remain valid and enforceable to the fullest extent permitted by law.
